1. Who we are

verth.it is operated by VERTH, a business established under the laws of the State of Wyoming, United States, with its principal address at 75 E 3rd Street, Sheridan, Wyoming 82801, United States. You can reach us at admin@verth.it.

2. Agreeing to these terms

These terms govern your use of this website. By using the site you accept them. If you do not accept them, please stop using the site. If you are using the site for a company, you confirm you are authorised to accept these terms for that company.

3. What this website is

This site describes what VERTH does. It is information, nothing more. Nothing on it is an offer capable of acceptance, a quotation, or a commitment to provide any service, and browsing it does not create a contract or any client relationship between us.

If we go on to work together, that work will be governed by a separate written services agreement signed by both of us. Where that agreement and these terms disagree, the services agreement wins.

4. No advice, and no promise of results

Content on this site is general commentary about business and marketing. It is not professional, legal, financial, accounting or tax advice, and you should not act on it without advice that takes your own circumstances into account.

Any figures, timelines or outcomes mentioned on this site are illustrative. Business results depend on your market, your product, your budget and a great deal that sits outside our control, so we do not promise any particular result from anything described here.

The VERTH name, the V mark, the wordmark, the tagline “become more, it’s verth.it”, and the text, layout, design, graphics and code of this site are owned by us or licensed to us, and are protected by United States and international intellectual property law.

You may view the site, and print or download extracts for your own reference. You may not republish, sell, rent, sub-license, or systematically copy material from it, use it commercially, or present it as your own, without our written permission. Our trade marks and trade dress may not be used without our consent.

The typefaces used on this site, Manrope and Inter, are third-party works used under the SIL Open Font License and remain the property of their authors.

6. How you may use this site

You agree not to:

• use the site unlawfully, fraudulently, or for any harmful purpose;
• attempt to gain unauthorised access to the site, its server, or any connected system;
• introduce malware, or otherwise attack the site, including by denial-of-service attack;
• scrape, harvest or systematically extract content from the site by automated means, or use it to train a machine learning model, without our written permission; or
• use the site in a way that damages it, or interferes with anyone else’s use of it.

Conduct of this kind may be a criminal offence under the United States Computer Fraud and Abuse Act and under Wyoming law. Where it is, we may report it to the relevant authorities and give them your identity.

Where we link to a site we do not run, we do so for convenience. We have no control over those sites and accept no responsibility for their content, their products, or how they handle your information.

8. Availability

We provide this site free of charge and on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will always be available, uninterrupted, secure or free of errors, and we may change, suspend or withdraw all or part of it at any time without notice.

9. Our liability

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that, and to the fullest extent the law allows, we are not liable for any loss of profit, loss of business, loss of revenue, loss of anticipated savings, loss of data, business interruption, or any indirect, incidental, special, punitive or consequential loss, arising out of or in connection with your use of, or inability to use, this site or anything you rely on from it. This applies whether the claim is in contract, tort including negligence, strict liability, or otherwise, and even if we have been advised that such loss was possible.

Our total aggregate liability in connection with this site will not exceed one hundred United States dollars (USD 100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you, and nothing here affects consumer rights that cannot be waived under the law where you live.

10. Indemnity

12. Governing law and where disputes are heard

These terms, and any dispute or claim arising out of them or out of your use of this site, including non-contractual disputes and claims, are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

You and we agree that the state and federal courts sitting in Sheridan County, Wyoming have exclusive jurisdiction, and you consent to personal jurisdiction and venue there. If you are a consumer resident in the European Economic Area or the United Kingdom, you keep any right you have to bring proceedings in the courts of the country where you live.

13. General

If any part of these terms is found unenforceable, the rest continues to apply. If we do not enforce a right straight away, that is not a waiver of it. You may not assign your rights under these terms without our consent. These terms, together with the Privacy Policy, are the whole agreement between us about this website.

14. Changes to these terms

We may update these terms from time to time. The version published here is the one that applies, and the date at the top tells you when it last changed. Please check it when you come back to the site.
